On 13 October 2020 Lincolnshire County Council confirmed the above-named Order.
The effect of the Order as confirmed is to divert the full width of Public Footpath No. 5 in the Parish of Langtoft running from King Street at Ordnance Survey Grid Reference TF 1087 1081 (A) in a generally east north easterly direction for approximately 520 metres to Ordnance Survey Grid Reference TF 1137 1095 (B) then continuing in a generally easterly direction for approximately 465 metres to terminate at the unaffected part of Public Footpath No. 5 at Ordnance Survey Grid Reference TF 1184 1092 (C). The total length of footpath to be diverted to be approximately 985 metres as shown between points A-B-C on Order drawing numbered 2019/010/PPO353/A4 TO AN ALTERNATIVE ROUTE in the Parish of West Deeping to be known as Public Footpath No.1153 and to be 2 metres wide running from King Street at Ordnance Survey Grid Reference TF 1090 1053 (D) in a generally east north easterly direction for approximately 663 metres to Langtoft Public Footpath No.5 at Ordnance Survey Grid Reference TF 1151 1078 (E). The total length of footpath to be added to be approximately 663 metres as shown between points D-E on Order drawing numbered 2019/010/PPO353/A4. Limitation: Kissing Gate 1.2 m wide at OSGR TF 1090 1053 – BS5709:2006 compliant. Also in the Parish of Langtoft to be 2 metres wide running from West Deeping Public Footpath No.1153 at Ordnance Survey Grid Reference TF 1151 1078 (E) in a generally north easterly direction for approximately 356 metres to terminate at the unaffected part of Public Footpath No. 5 at Ordnance Survey Grid Reference TF 1184 1092 (C). The total length of footpath to be added to be approximately 356 metres as shown between points E-F-C on Order drawing numbered 2019/010/PPO353/A4. Limitation: Kissing Gate 1.2 m wide at OSGR TF 1166 1084 – BS5709:2006 compliant.
A copy of the confirmed Order and the Order plan have been placed and may be seen at the offices of Lincolnshire County Council, Lancaster House, 36 Orchard Street, Lincoln, LN1 1XX. The Order and plan have been displayed in the ground floor reception window to allow viewing from outside the building only. Any person who wishes to claim compensation under section 28 as applied by section 121(2) of the 1980 Act for depreciation or damage for disturbance arising as a result of the coming into force of the Order must make a claim in writing addressed to Legal Services Lincolnshire, 45-49 Newland, Lincoln, LN1 1YS, marked for the attention of Sally Ironmonger and quoting reference SXI.PLA021.14 LANGTOFT and serve it by delivering it at, or sending it by prepaid post to, that address not later than 11 May 2021. A copy of the sections is attached.
The Order came into force as from 10 November 2020 but if a person aggrieved by the Order desires to question its validity, or of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 11 December 2020 make an application to the High Court.
